Sail Warranty Terms and Conditions

Supplier: Shade Space (“Shade Space”, “we”, “our”)
Customer: The purchaser of Shade Space products (“you”, “your”)
1. Overview
These Terms and Conditions apply to all custom shade sails (“Product(s)”) purchased through the Shade Space Custom Shade Sail Configurator available on our website. By using the Configurator and placing an order, you agree to these Terms and Conditions.
Shade Space manufactures each Product according to the measurements and specifications you provide through the Configurator. It is your responsibility to ensure that these measurements are accurate and verified according to our measuring instructions.
2. Customer Responsibilities
2.1 Measurement Accuracy
You are responsible for ensuring that:
- All measurements entered into the Configurator are accurate and complete, and
- Your site or structure is built or prepared in accordance with those measurements.
We recommend double-checking all dimensions and verifying fixing points, heights, and clearances before placing your order.
2.2 Measurement Instructions
Shade Space provides detailed measuring instructions to assist you in obtaining accurate measurements. You must follow these instructions carefully. Shade Space is not responsible for any outcome resulting from inaccurate, incomplete, or unverified measurements.
2.3 Changes to Site or Structure
If changes are made to the site or structure after your order is placed, any resulting fit or installation issues are the responsibility of the customer.
3. Workmanship Warranty
3.1 Scope of Warranty
Shade Space warrants the workmanship and materials used in the manufacture of your Product. We will repair or replace, at our discretion, any Product found to have defects in workmanship or materials under the conditions set out below.
3.2 Warranty Period
This workmanship warranty is effective for the same duration as the fabric manufacturer’s warranty applicable to the material used in your Product. (Refer to the separate Fabric Warranty for details.)
3.3 Exclusions
This warranty does not cover:
- Products affected by inaccurate or unverified measurements supplied by the customer.
- Damage caused by improper installation, including poor design, inadequate supports, incorrect tensioning, or unsuitable fixing points.
- Misuse, alteration, vandalism, or use for purposes other than intended.
- Damage caused by extreme weather or acts of nature.
- Damage resulting from lack of maintenance or failure to follow care instructions.
- Colour fading, chemical damage, or proximity to open flame or heat.
- Transit damage (claims must be made directly with the freight company upon delivery).
- Normal characteristics of textile manufacturing such as seams, joins, or minor colour variation between fabric rolls.
- Gradual sagging due to natural fabric stretch. Re-tensioning is a normal part of maintenance and should be done annually.
3.4 Customer Maintenance Obligations
You are responsible for:
- Maintaining proper sail tension after installation; and
- Conducting periodic checks or professional maintenance to ensure the sail remains correctly tensioned and secure.
3.5 Remedy
If a valid claim is made under this warranty, Shade Space will, at its discretion, repair or replace the Product or affected component. Refunds are not provided except where required by law.
3.6 Liability Limitation
Shade Space’s maximum liability under this warranty is limited to the invoiced value of the Product. Shade Space is not liable for any indirect or consequential loss, including installation, removal, or labour costs.
4. Warranty Claim Process
4.1 Submitting a Claim
If you believe your Product is defective due to workmanship or materials:
- Contact your installer or Shade Space within 90 days of discovering the issue.
- Provide a written description and photographs showing the defect, along with proof of purchase.
4.2 Assessment
Shade Space will review your documentation and may request additional information or inspection before determining eligibility under this warranty.
4.3 Resolution
If approved, Shade Space will repair or replace the Product in accordance with Section 3.5.
5. General Terms
5.1 Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand.
5.2 Amendments
Shade Space may update these Terms at any time. Updated versions will take effect immediately upon posting on our website and will apply to future orders.
5.3 Acceptance of Terms
By placing an order using the Custom Shade Sail Configurator, you confirm that you have read, understood, and agree to these Terms and Conditions.
